Please read these terms carefully before ordering from vehiclebearings.co.uk (the “Site”). By placing an order, you agree to be bound by them.
1. Who we are
References to “we”, “us” and “our” are to Vehicle Bearings. Our contact email is [email protected]. These terms are governed by the law of England and Wales, and, subject to Section 12, the courts of England and Wales have exclusive jurisdiction over any dispute.
2. Eligibility
You must be at least 18 years old and legally capable of entering into a binding contract to place an order on the Site.
3. Product information
We make reasonable efforts to ensure bearing specifications, dimensions and descriptions are accurate. However:
- Specifications are provided as a guide to help you identify the correct part; you are responsible for confirming fitment and suitability for your intended application before ordering and before fitting.
- Minor variations in appearance, packaging, or manufacturer branding between what is shown and what is supplied may occur and do not constitute a fault.
- Colours, images and diagrams are for illustration and may vary from the actual product.
4. Orders and formation of contract
- Placing an order through the Site is an offer by you to purchase the goods, which we may accept or decline at our discretion.
- No contract exists between us until we send a dispatch confirmation for the relevant item(s). An order acknowledgement or payment confirmation is not acceptance of your order.
- We may decline or cancel an order at any time before dispatch, including (without limitation) where: the item is unavailable, we identify a pricing or listing error, we suspect fraud, or we are unable to verify your details. Where we cancel an order for these reasons, we will refund any payment taken in full and will have no further liability to you.
- If a pricing or description error is discovered after dispatch confirmation, we may still cancel the contract and will refund all sums paid; our liability is limited to that refund.
5. Pricing and payment
- All prices are shown in GBP and, unless stated otherwise, are inclusive of any applicable VAT.
- We reserve the right to change prices at any time; changes will not affect orders for which we have already sent a dispatch confirmation.
- Payment is taken at the time of order. Full payment must be received and cleared before goods are dispatched.
6. Delivery
- Delivery estimates given at checkout or on the Site are estimates only and are not guaranteed delivery dates. Time of delivery is not “of the essence” for the purposes of this contract.
- Risk in the goods (e.g. loss or damage in transit) does not pass to you until the goods are delivered to you or a person you nominate.
- If delivery is delayed significantly beyond any estimate given, your remedy is to contact us; if we cannot provide a new delivery date or the delay is unreasonable, you may cancel the order for a full refund of that item. This does not limit any other statutory right you have.
- You are responsible for providing a correct and complete delivery address. We are not liable for non-delivery or delay caused by an incorrect address supplied by you, and any redelivery or return costs arising from this will be charged to you.
- Ownership (title) of the goods does not pass to you until we have received payment in full.
7. Your responsibility when fitting bearings
Bearings are mechanical safety-relevant components. By purchasing from us, you acknowledge and agree that:
- Selecting the correct bearing, and fitting it correctly, is your sole responsibility (or that of the competent person carrying out the fitting).
- We are not a fitting or installation service and provide no advice, warranty, or representation as to suitability for a specific vehicle, machine or use case beyond the published dimensional specification, unless expressly confirmed by us in writing.
- We accept no liability for damage, loss, or injury arising from incorrect selection, incorrect fitting, use outside the bearing’s rated specification, or use by an unqualified person, save to the extent such liability cannot be excluded by law (see Section 9).
8. Returns and refunds
Returns and refunds are governed by our separate [Refund & Returns Policy], which forms part of these terms.
9. Liability
- Nothing in these terms excludes or limits our liability for: death or personal injury caused by our negligence; fraud or fraudulent misrepresentation; defective products under the Consumer Protection Act 1987; or any other liability which cannot lawfully be excluded or limited.
- Subject to the above, and to your statutory rights under the Consumer Rights Act 2015, our total liability to you arising out of or in connection with an order is limited to the price paid for the goods giving rise to the claim.
- Subject to the above, we exclude all liability for indirect or consequential loss, including loss of profit, loss of use, loss of a vehicle or machine’s operation, or damage to other components or property arising from a failed or incorrectly fitted bearing.
- Nothing in this section affects your statutory rights as a consumer under the Consumer Rights Act 2015, which cannot be excluded.
10. Intellectual property
All content on the Site — including text, images, logos and the bearing size chart — is owned by us or our licensors. You may not copy, reproduce, or reuse it for commercial purposes without our prior written consent.
11. Complaints and dispute resolution
If you have a complaint, contact [email protected] and we will aim to resolve it directly. We are not currently signed up to any Alternative Dispute Resolution (ADR) scheme. If we cannot resolve a dispute directly, you may seek guidance from the Citizens Advice consumer helpline or your local Trading Standards service.
12. Consumers outside England and Wales
If you are a consumer resident elsewhere in the UK, mandatory local consumer protection laws that cannot be contracted out of will still apply to you, and you may also be able to bring proceedings in the courts of the part of the UK in which you live. Nothing in Section 1 removes those rights.
13. General
- Force majeure: We are not liable for any delay or failure to perform caused by events outside our reasonable control (e.g. courier failures, extreme weather, industrial action).
- Severability: If any part of these terms is found unenforceable, the rest will remain in full force.
- No waiver: A failure by us to enforce any part of these terms is not a waiver of our right to do so later.
- Entire agreement: These terms, together with our Refund & Returns Policy and Privacy Policy, form the entire agreement between us for your order.
- Third party rights: No one other than you and us has any right to enforce these terms (Contracts (Rights of Third Parties) Act 1999 excluded).
- Changes: We may update these terms from time to time. Changes will not apply retrospectively to orders already placed.
